Please read these terms carefully before using the Hawky platform.

1. Who we are

Hawkerkart Online Private Limited ("Hawky", "we", "us", "our") operates the Hawky mobile application and website (www.hawky.in). Our registered office is at No. 29, 6th Cross, Dinnur, RT Nagar, Bangalore 560032, India.

2. Acceptance of terms

By downloading, installing, or using the Hawky application or website, you ("User", "you") agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

3. Services

Hawky is a technology platform that connects customers with nearby street food vendors and local food businesses for ordering and delivery. We act as an intermediary and do not ourselves prepare, package, or deliver food.

4. Eligibility

• You must be at least 18 years of age to create an account.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.

5. Orders and payments

• All prices listed on the platform are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
• Once an order is confirmed and accepted by the vendor, it cannot be cancelled except as permitted by our cancellation policy.
• Payment is processed through third-party payment gateways. We do not store your payment card details.
• Refunds, if applicable, are processed as per our refund policy and may take 5-7 business days to reflect.

6. User obligations

You agree not to:

• Use the platform for any unlawful purpose.
• Impersonate any person or entity.
• Interfere with or disrupt the platform or its servers.
• Attempt to gain unauthorized access to any part of the platform.
• Use automated systems (bots, scrapers) to access the platform without our written permission.

7. Vendor responsibilities

Vendors listed on Hawky are independent businesses. They are solely responsible for the quality, safety, and hygiene of the food they prepare and sell. Hawky does not guarantee the quality of any vendor's products.

8. Delivery

• Estimated delivery times are approximate and may vary based on distance, traffic, weather, and vendor preparation time.
• Delivery partners are independent contractors, not employees of Hawky.
• You must provide an accurate delivery address and be available to receive the order.

9. Intellectual property

All content on the Hawky platform, including logos, designs, text, graphics, and software, is the property of Hawkerkart Online Private Limited and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Account termination

• You may delete your account at any time through the app (Profile → Delete Account) or by emailing info@hawky.in.
• We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the platform.

11. Limitation of liability

To the maximum extent permitted by law:

• Hawky is not liable for any indirect, incidental, or consequential damages arising from the use of the platform.
• Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
• We are not responsible for delays, failures, or disruptions caused by circumstances beyond our reasonable control.

12. Disclaimer

The platform is provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, to the fullest extent permitted by law.

13. Privacy

Your use of the platform is also governed by our Privacy Policy. By using Hawky, you consent to the collection and use of your information as described therein.

14. Governing law & disputes

These terms are governed by the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

15. Changes to these terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. Continued use of the platform after changes constitutes acceptance of the revised terms.
